Terms of Sales

To access the purchase of champagne or wines on the site shop.maisonsarment.com, you certify that you are of legal age (at least 18 years old on the day of the order) and have read the regulations in force relating to the sale of alcoholic drinks on the internet

1. Payment terms

Payments by credit card are entirely secure by our bank Société Générale as well as the PayPlug payment solution. For online bank card payments, we have no knowledge of your banking details at any time; this information is and remains confidential. Payments by transfer, bank check, postal order or offline bank card are accepted. Invoices are subject to cash payment, net without discount.

2. Prices

Prices are indicated All Taxes Included, excluding shipping costs. Prices therefore take into account current VAT as well as excise and other applicable taxes.
The company reserves the right to modify its prices at any time, but the products ordered are invoiced at the price in effect at the time the order is registered.
The prices and offers on the site are only intended for private customers and in no case for professional resellers.

3. Shipping costs

Shipping costs are a flat rate per destination region. In the event of an error in the delivery address provided by the customer, forcing our company to return the orders to its warehouse, the customer will bear the consequences. Furthermore Vin sur 20 will be entitled to invoice the administrative and transport costs associated with the return of orders. In the event of late receipt of payment Vin sur 20 cannot be held responsible for delivery times.

4. Reservation of title

The products remain the property of our company until full payment of the order, in accordance with the terms of Law No. 80 335 of May 12, 1980 relating to retention of title. The products are only sent to their recipient after full payment of the order.

5. Product availability

The products are offered for sale while stocks last. The images are not always contractual. In the event of a stock shortage, we reserve the right to replace it with a product from the same region, of the same vintage or of a different vintage, of a value at least equal to or greater than the unavailable bottle but as a matter of principle we always ask for the customer's agreement before making a possible change.

In this case, the customer waives any damages. Depending on availability and winegrowers' stocks, vintages may vary from one year to another but we cannot be held responsible for sudden changes in vintages imposed by our suppliers.

When a vintage is sold out, we automatically move on to the following year's vintage. We are notified of the change in vintage on the day of receipt of the goods. Therefore, it is possible that between the date the customer placed the order and the day we receive the restock, the vintage is not the same. In all cases, we contact the customer to obtain their agreement to send the goods.

6. Deliveries and responsibilities

Deliveries are made by Carrier (GLS or Kuehne nagel). We announce an estimated delivery time from validation of the order. Any delays do not give the buyer the right to cancel the sale, refuse the goods or claim damages. The customer is informed of the delivery day by e-mail or by telephone.

If you are absent during delivery, the carrier will leave a delivery notice. Then, you will need to schedule another appointment day with the carrier. You cannot cancel the sale for non-delivery in the event that you are absent. In this case, you cannot claim damages or refuse delivery.
The delivery address is that specified on the order form that you validated. Vin sur 20 cannot be held responsible for any error if the delivery address is incorrect. In this case, any return to our warehouse may incur costs, billable to the ordering party, in accordance with article 3 of the general conditions of sale.
The goods always travel at the risk of the recipient. Always check your package upon arrival, in the presence of the delivery person, to certify that there are no broken bottles and that the order complies with the delivery note. Once the order conformity certificate has been signed, you will not be able to appeal in the event of broken bottles or non-compliance of the order. You have 48 hours to make any reservations with the carrier or Vin sur 20 in the event of a missing or damaged product.

7. Withdrawal periods

In application of article L. 121-16 of the Consumer Code, within 14 days following delivery of their package, each recipient may return the goods at their own expense in their original packaging to the address indicated on the Delivery Note. The refund will be made to the ordering party upon receipt of the goods by our warehouse, deduction of shipping costs, and any non-intact products.

8. Competent jurisdiction

These general conditions of sale will be subject to French law. By express agreement, the Commercial Court of Toulouse is competent to rule on all disputes relating to the formation or execution of the order or in the event of a dispute of any nature unless our company prefers to refer the matter to any other competent jurisdiction. However, in the event that a dispute arises from this contractual relationship, the parties undertake, before any legal action, to seek an amicable solution.

9. Protection of minors

In accordance with article L. 3342-1 of the Public Health Code which stipulates that the sale of alcohol to minors under eighteen (18) years of age is prohibited, the buyer undertakes, by completing the voucher order, to be eighteen (18) years old on the date of the order. 10. If there is a problem with your order: what to do

It may happen that you find yourself faced with a problem with your order: damaged package, broken bottle, deterioration, bad product... In this case, you must initiate a dispute procedure.

For a dispute to be opened, it is imperative to:

 Check the package in the presence of the delivery person even if he is in a hurry

– Note “ REFUSED ” on the delivery note

– Return the goods to the delivery person so that they can be returned to us even if it is a bottle neck, glass, etc.

How to proceed ?

  1. If you notice any deterioration of the packaging resulting in visible or invisible damage, you must carry out clear, precise reservations and detailed on the delivery note or waybill, indicating the name of the wine, the vintage and the vintage. The statement “subject to unpacking” is not valid in the event of a complaint.
  2. Following this, the carrier will then repatriate the order directly to our warehouses so that our team can carry out an assessment of the package.
  3. Then you need to send an email to logistics@vinsur20.com in order to alert our teams of the situation. Once we receive the return of the goods, we can then set up the dispute procedure and proceed to send a new order or a refund, depending on what you wish.
